46. Explosives Control Law


(1) PURPOSE OF THE LAW AND SYSTEM
The purpose of this law is to prevent any disaster that might be caused by explosives and thereby to maintain public security by regulating manufacture, sale, storage, transportation, consumption, and other treatment of explosives.

(2) OUTLINE OF THE LAW AND SYSTEM
Any person intending to manufacture explosives shall obtain permission from the Ministry of Economy, Trade and Industry for each plant or site of manufacture (Article 3). Any person intending to perform sale business of explosives shall obtain permission from the respective prefectural governor for each shop (Article 5).
Any person intending to establish or move an explosives warehouse, and any person intending to transfer or take over explosives, shall obtain permission from the respective prefectural governor (Articles 12 and 17).
Any person intending to import explosives shall obtain permission from the respective prefectural governor (Article 24).
Any person intending to blast, burn, or abandon explosives shall obtain permission from the respective prefectural governor (Articles 25 and 27).

Any person intending to import explosives shall submit an application form for the import of explosives on which the type, quantity, and purpose of the import, as well as the place of storage or description of warehouses, etc. is described in detail, together with documents describing components, mixing ratio for explosives, and structure and composition for explosive articles, and obtain permission from the respective prefectural governor concerning loading places thereof.
