53. Law Concerning Special Exceptions To Customs Law, Etc. Accompanied By The Enforcement Of Convention On The ATA Carnet For The Temporary Admission Of Goods (ATA Convention)


(1) PURPOSE OF THE LAW AND SYSTEM
The objective of this law is to provide special exceptions to the customs law and customs tariff law and other necessary matters for the enforcement of Customs Convention on the ATA Carnet for Temporary Admission of Goods (ATA convention).

(2) OUTLINE OF THE LAW AND SYSTEM
Importers of temporarily articles may use the ATA carnet for importing them into their own country and perform bonded transportation of such articles.

Enforcement Order of the Law Concerning Special Exceptions to Customs Law etc., accompanied by the enforcement of Customs Convention on the ATA Carnet for the Temporary Admission of Goods CATA Convention).

(4) OUTLINE OF SPECIFICATIONS, STANDARDS AND INSPECTIONS, ETC.
1) Items Covered
All articles except those specified by Items 1 and 4 of Paragraph 1 of Article 17 of Customs Tariff Law, among articles enumerated in each item of the same Article (things for research, specimens, articles to be displayed in exhibitions, shows, trade fairs, sample fairs, joint auspice fairs, and other similar exhibitions).

2) Outline of the Control, etc.
i.Content of the control
Any article which falls under any of the prescribed in the precedent paragraph is exempted from Customs duties etc. if it will be re-exported between the day on which the imported articles by use of the ATA carnet for which permission is granted and the day when the validity of the carnet expires (Article 4).

ii.Procedures for the establishment and/or amendment of specifications, standards and inspections etc.
In international convention, there is a Customs Convention on the ATA Carnet for the Temporary Admission of Goods CATA Convention).

iii. Procedure for application
Applicants file an application for issuance of the ATA Carnet with competent issuing organizations in migratory countries of the ATA convention (The Japan Commercial Arbitration Association in the case of Japan).
Applicants should submit their ATA carnet to the Customs Office regarding temporary import procedures when making use of the ATA carnet.
