Subject | Explanation of the system providing redress in the event of copyright infringement. | ||
Details of Measures | Both Japan and the United States are parties to the Berne Convention for the Protection of Literary and Artistic Works, and Japanese copyright law provides that the aggrieved party may petition the courts for (1) relief under civil law including a cease-and-desist order and indemnification and (2) relief under criminal law penalties if complaint is brought. It was replied that judgment on each should be decided by the courts, such as whether or not the directory in question is copyrighted material, whether or not there was a copyright infringement, and other issues. |
