Details of Measures | All foodstuffs which are suspected of possibly being in violation of the Food Sanitation Law must be inspected at a quarantine station upon import so as to protect the public health. In so doing, the quarantine stations accept and consider inspection results and other materials submitted by such non-profit corporations as designated by the Ministry of Health and Welfare. The inspection agencies cited in this complaint are private-sector organizations, and it was explained that it would be very difficult for a government agency to intervene and to instruct them to standardize and lower their rate structures and that, since it is assumed that their rate structures are set on a non-discriminatory manner based upon market forces, such intervention would possibly be in violation of the Law Concerning the Prohibition of Private Monopoly and Preservation of Fair Trade (the Antimonopoly Law). |
