OTO No. 432 Classification MHW-207
Date of Acceptance October 8, 1990 Ministry/Agency Receiving Complaint Economic Planning Agency
Responsible Ministries Ministry of Health and Welfare Related Laws Food Sanitation Law
Complainant Domestic firm Exporting Countries Sri Lanka
Subject Standardization and lowering of import inspection fees.
Details of Measures All foodstuffs which are suspected of possibly being in violation of the Food Sanitation Law must be inspected at a quarantine station upon import so as to protect the public health.
In so doing, the quarantine stations accept and consider inspection results and other materials submitted by such non-profit corporations as designated by the Ministry of Health and Welfare.
The inspection agencies cited in this complaint are private-sector organizations, and it was explained that it would be very difficult for a government agency to intervene and to instruct them to standardize and lower their rate structures and that, since it is assumed that their rate structures are set on a non-discriminatory manner based upon market forces, such intervention would possibly be in violation of the Law Concerning the Prohibition of Private Monopoly and Preservation of Fair Trade (the Antimonopoly Law).
