Details of Measures Under the Food Sanitation Law, the necessary restrictions are used to ensure the safety of foods for sale.
The Food Sanitation Law makes no exceptions for foods meant for special purposes, and even though the product in question is water for emergency use intended to be used in limited circumstances, the provisions of the Food Sanitation Law apply to this product as to all foods in general.
At the importer's request, the product in question was tested at a facility designated by the Ministry of Health and Welfare. The complainant was advised that since the product failed to meet one of the specifications for foods under the Food Sanitation Law (the ingredient specification for soft drinks "that the product be free of precipitates"), it appears that the importer refrained from importing the product.
The sample tested in October 1992 appears to have met the ingredient specifications for soft drinks in accordance with food specifications, and when it was further explained to the complainant that if the product was ascertained to have conformed with food specifications when tested at the time of import after the above-mentioned problem had been remedied, the product could be imported. Accordingly, the complainant indicated that they wished to end processing of this complaint at this point.
It appears that the product was subsequently imported.
