Details of Measures | Description of Complaint: The complainant wanted to import magazines and videos for adults, and complains that import was not permitted as the articles fall under Article 21, Section1, Clause 4 of the Customs Tariff Law and requests that import be permitted The ministry replied as follows: 1. Materials harmful to public morals or so-called pornographic materials are banned imports, under the provisions of Article 21, Section 1, Clause 4 of the Customs Tariff Law. Further, under the provisions of Section 3 of the Law, the director general of Customs shall, if there is appropriate reason to consider the relevant materials pornographic, give notice to that effect to the prospective importer of said materials. 2. Persons receiving such a notice from the director general of Customs, may, if dissatisfied, file a complaint under the provisions of Article 89 of the Customs Tariff Law. 3. Judgment as to whether materials are harmful to public morals is made by Customs, taking current social conditions into consideration, and based on precedents and the results of examination by the Customs Complaint Review Committee. |
