Details of Measures | Description of Complaint: A business license must be acquired for the sale of model rocket engines (containing more than 20 g of explosives). Under current statutes, it is necessary to own or occupy an explosives warehouse in order to acquire the said license. The complainant argues that this requirement is a heavy burden for persons handling small quantities of explosives and that either of the following measures should be adopted. 1. Diversify or subdivide license standards in accordance with the nature of the merchandise and the amount of explosives handled, by setting standards for storage facilities other than explosives warehouses. 2. Raise the minimum volume of explosives, etc. for model rocket engines that would be recognized as toy signal fires not subject to the license. The ministry replied as follows: The prefectures were notified that in cases like this complaint, when sellers sell only secondary products using a small quantity of explosives, and when they have sufficient storage to store the product in question returned in the case of defects, an exception will be made to allow sellers to store explosives, up to the maximum amount specified in the regulations concerning implementation of the Explosives Control Law and when storage is carried out according to the technical standards set out in the above regulations. |
